1. Introduction

These Terms of Service ("Terms") govern your use of the GembaX platform and website at gembax.ai (the "Service"), operated by Moresight Consulting ("we," "us," "our").

By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Service Description

GembaX is an AI-powered operational diagnosis platform that identifies and quantifies hidden waste in business operations using the TIM WOODS + Theory of Constraints framework. All waste is reported in dollar terms.

3. Service Tiers & Pricing

We offer three service tiers:

• Scan ($550): Focused operational scan — top 3 waste categories identified and quantified in dollars, with industry benchmarks.
• Diagnosis ($1,000): Full Hidden Cost Report — all 7+1 waste categories, bottleneck detection, Pareto analysis, 90-day action plan with ROI projections.
• Transformation (Custom pricing): Enterprise implementation delivered by Moresight Consulting — process redesign, change management, and ongoing support.

Prices are in US Dollars (USD) and are one-time payments unless otherwise stated. We reserve the right to adjust pricing; changes will not affect confirmed orders.

4. Payments

Payments are processed securely through Stripe. We do not store your credit card details. By making a purchase, you represent that you are authorized to use the payment method provided.

5. Refunds

We offer a 14-day satisfaction guarantee on Scan and Diagnosis reports. Full details are in our Refund Policy.

6. Your Obligations

You agree to provide accurate and complete information during the intake process. You must be at least 18 years old and authorized to act on behalf of the business being analyzed.

7. Intellectual Property

All GembaX content, methodologies, frameworks, branding, and software are the intellectual property of Moresight Consulting. Reports are licensed for your internal business use only and may not be resold or publicly distributed.

8. Privacy

We collect and process data as described in our Privacy Policy. We do not sell your data.

9. Disclaimer

The Service is provided "as is." Reports are advisory and do not constitute professional financial, legal, or management consulting advice. We do not guarantee specific cost savings or business outcomes.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability shall not exceed the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

11. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Disputes shall be resolved in the courts of Istanbul, Turkey.
